Statutory Consultation with the Local Community under Part 8 of the Community Empowerment (Scotland) Act 2015 for Disposal of Common Good Land – Proposed sale of land at Former Banff Community Centre and Area of Land at Lower Deveronside.


What land is being consulted on?

The land concerned (“the Land”) is situated around the former Bridge Street Community Centre, Banff; it is shown coloured blue on the undernoted plan and forms the adjacent land to the front, back and side of the former community centre including the former tennis courts


The Proposed sale

Aberdeenshire Council on 27 January 2026 has made the preliminary decision to sell the former Bridge Street Community Centre and adjacent land to Eastside Discount Centre Limited Banff, subject to this consultation, and court approval. The proposed use of the site is to introduce new leisure, retail and community focused facilities to the area. Eastside Discount Centre Limited said, ‘We are ready to transform it into something that inspires pride, creates employment, increases footfall and helps put Banff firmly back on the map.’


Why are we consulting?

The land (not the former Community Centre) is part of a greater area of land which was gifted to the Councils predecessors by the Duke of Fife to the Burgh Councils of Banff and Macduff in 1907 and there are existing Court decisions which have determined this land is inalienable common good land. When considering disposal of this type of Common Good Land (whether by sale or lease), certain legal requirements must be followed. These are:

  • Carry out a statutory consultation with the Local Community under Part 8 of the Community Empowerment (Scotland) Act 2015;
  • Seek approval from the Court under s.75 of the Local Government (Scotland) Act 1973.
  • This consultation is being carried out to satisfy the first legal requirement and further guidance on the process can be found here.

Court approval will be sought if the Banff and Buchan Area Committee decides to proceed with the disposal following the Public Consultation.
